Amendments to Regulation 854 (Mines and MIning Plants) / / Modifications au Règlement 854 (Mines et installations minières)

Effective July 1, 2019, amendments to the various provisions of Regulation 854 (Mines and Mining Plants) under the Occupational Health and Safety Act (OHSA) come into effect that will:

 

  • Harmonize the definition of “non-destructive test” and related requirements with O. Reg. 213/91 (Construction Projects) to improve the clarity, consistency and transparency of these provisions;
  • Revoke several provisions that are redundant or duplicative with other requirements, thereby reducing regulatory burden;
  • Update various references to recognized industry standards to keep the regulation up-to-date;
  • Amend existing requirements regarding the allowable height of working faces at surface mines and regarding oxygen/acetylene containers, providing workplaces with alternate ways of complying with these requirements, thereby increasing flexibility; and
  • Amend miscellaneous requirements to update terminology and/or clarify certain requirements.

 

In addition, amendments have been made to other OHSA regulations and will also come into effect on July 1, 2019, including:

  • Construction Projects (O. Reg. 213/91)
  • Occupational Health and Safety Awareness and Training (O. Reg. 297/13)
  • Industrial Establishments (Regulation 851)
  • Oil and Gas – Offshore (Regulation 855)

 

Amendments to Regulation 833 (Control of Exposure to Biological or Chemical Agents) and O. Reg. 490/09 (Designated Substances) will come into force on January 1, 2020 to provide workplaces additional time to comply with the amendments.

It is expected that the amendments will be consolidated into their respective regulations in the near future.

 

 

À compter du 1er juillet 2019, des modifications à diverses dispositions du Règlement 854 (Mines et installations minières) pris en application de la Loi sur la santé et la sécurité au travail (LSST) entreront en vigueur. Elles :

 

  • Harmonisent la définition du « test non destructif » et des exigences connexes avec le Règl. de l’Ont. 213/91 (Chantiers de construction) pour améliorer la clareté, l’uniformité et la transparence de ces dispositions.
  • Révoquent plusieurs dispositions qui sont redondantes ou qui font double emploi avec d’autres exigences, réduisant ainsi le fardeau réglementaire.
  • Mettent à jour diverses références pour reconnaître les normes de l’industrie afin de tenir le règlement à jour.
  • Modifient les exigences existantes concernant la hauteur permise des fronts d’exploitation des mines de surface et les contenants d’oxygène/d’acétylène pour offrir d’autres moyens aux lieux de travail de se conformer à ces exigences, pour ainsi leur offrir une plus grande souplesse.
  • Modifier diverses exigences pour mettre à jour la terminologie ou clarifier certaines exigences.

 

De plus, des modifications ont été apportées aux règlements aux termes de la LSST et entreront également en vigueur le 1er juillet 2019. Les règlements comprennent :

 

  • Chantiers de construction (Règl. de l’Ont. 213/91)
  • Sensibilisation à la santé et la sécurité au travail et Formation (Règl. de l’Ont. 297/13)
  • Établissements industriels (Règlements 851)
  • Pétrole et gaz extracôtiers (Règlement 855)

 

Des modifications au Règlement 833 (Contrôle de l’exposition à des agents biologiques ou chimiques) et au Règlement 490/09 (Substances désignées) entreront en vigueur le 1er janvier 2020 pour donner plus de temps aux lieux de travail de se conformer aux modifications.
